The Driver in Crash that Killed Minooka Resident Nicholas K. Frank is Sentenced

Mark Shubert was nearly three times over the legal limit when he drove head-on into a car on Ridge Road and killed Frank, who was the passenger.

A Plainfield man with two previous drunken-driving convictions on his record has been sentenced to five years in prison for a DUI accident that killed a Minooka man last year.

Mark A. Shubert, 41, pleaded guilty to aggravated DUI and reckless homicide in the Feb. 20, 2010, accident in which he drove his pickup truck into an oncoming lane of Ridge Road and struck a car head-on, according to a media release from the Kendall County state's attorney's office.

The driver of the car survived but his passenger, Nicholas K. Frank, was killed.

Shubert's blood alcohol content was found to be .223, nearly three times the legal limit.

Shubert agreed to plead guilty in order to avoid a trial, with his defense attorney arguing he should be sentenced to probation, the release said.

Prosecutors cited his two previous DUI convicitions to urge Judge John Barsanti to hand down the maximum 12-year prison term sentence.

"After taking the life of a young man, such as Mr. Shubert did, and with his history of drinking and driving, the only way to ensure that Mr. Shubert does not commit this crime again is to sentence him to prison, where we know he will be unable to drink and drive," Kendall County State's Attorney Eric Weis said in the release.

Under Illinois law, Shubert will be required to serve 85 percent of his sentence followed by two years of released supervision, the release said.
