The Will County prosecutor was trying to eat her lunch when the homeless man allegedly spat on her.

A homeless man allegedly spat on a Will County prosecutor while she was trying to eat her lunch by a downtown fountain.

The man, 58-year-old Richard Arreguin, was charged with battery Thursday for the alleged April 29 expectoration.

Arreguin was already in custody at the Will County jail on a charge of violating an order of protection. A woman residing at the downtown Plaza Hotel secured the protective order against Arreguin the same day he allegedly spat on the assistant state's attorney.

In her petition for the order, the woman accused Arreguin of stalking her, exposing himself to her, possibly drugging her, groping her, and spitting on her.

Arreguin violated the order by coming around the woman, said special prosecutor Dave Neal.

Neal said he did not know why Arreguin allegedly spat on the assistant state's attorney, who he said was having lunch with another prosecutor when Arreguin accosted them and let his saliva fly.

Arreguin only hit one of the two prosecutors, Neal said.
